Definitions

This document ("Terms and Conditions") uses those terms:

  • Guillaume Piolat EI (Auburn Sounds) is hereby referred as "The Company".
  • The website you are browsing (auburnsounds.com) is hereby referred to as "The Website".
  • The software distributed on the Website (the Free Editions) is referred to as "Free Editions".
  • The software sold by resellers (the Full Editions) is referred to as "Full Editions".
  • The combination of Free Editions and Full Editions is referred to as "The Product".

Governing Law. Court Jurisdiction

All disputes relating the Terms and Conditions are subject to the laws of France. In the event of a dispute, French courts shall have sole jurisdiction.

Hosting

Resellers

The Full Editions are sold by various third parties ("The Resellers"). Each is a Merchant of Record for their own sales.

Of those Resellers, itch.io is the most common one.

Any entity that sells or distribute The Full Editions outside of an agreement with The Company is not part of The Resellers.

Refunds, cancellation and invoicing follow The Resellers' own terms. The Terms and Conditions here don't govern Resellers' purchases.

Copyright Notice

The content of this website and each and any of its elements, whether or not copyrighted or otherwise protected by all applicable laws, remain the property of The Company.

Any reproduction, extraction, display, modification, adaptation or use of the information contained in this site (including the Product) without the explicit authorization of The Company is prohibited.

The trademarks, trade names, logos and other distinctive signs of The Company are protected by the French legislation. Any unauthorized use or reproduction is prohibited.

Access And Use Of The Website

You agree that when using the Website, you will not:

  • distribute via any media any part of the Website;
  • use software to harvest information from the Website.

You are responsible for ensuring that no person uses your equipment to access the Website without your permission. The Company will be entitled to assume that anyone who accesses the Website using your equipment and your personal information has your permission to do so and you will be responsible for any charges, costs or liabilities that may be incurred.

End User License On The Website

The Company grants you a limited, non-exclusive, non-transferable license, to access and view any The Company's contents on the Website.

You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit any contents of the Website, except as expressly permitted in the Terms and Conditions.

End User License On The Product

By downloading and using The Product, you expressly agree to the terms of the license provided in the software archive.

By downloading and installing the Free Editions, you agree to the provisions of those Terms and Conditions.

When downloading the Free Editions, you are granted a personal license to use it for evaluation purposes. This license is non-exclusive and non-transferable. You are not allowed to lend, loan, lease, rent, use it as part of a service, sell or distribute the Free Editions in any form.

Unless special agreement, you are not allowed to lend, loan, lease, rent, use it as part of a service, sell or distribute the Full Editions in any form.

Limited Warranties

Except as expressly provided in the Terms and Conditions and to the maximum extent permitted by applicable law, the Website and all contents, materials and information provided through it are provided on an "as is" basis, without affecting your statutory rights as a consumer.

Without limiting the foregoing, The Company cannot guarantee and does not promise that the Website and all materials and information provided through it will meet your requirements.

Therefore The Company advises you to check any materials or information provided to you through the Website as any reliance that you place on the accuracy, completeness, currency or reliability of that information is at your own risk.

Nothing limits the consumer's statutory warranty and mandatory-law rights.

Limitations of Liability

Nothing in the Terms and Conditions limits or excludes The Company's liability for: (a) death or personal injury caused by its negligence; (b) any loss suffered by you as a result of your reliance on any fraudulent misrepresentation made by The Company to you; or (c) any other liability which may not by law be limited or excluded.

To the maximum extent permitted by applicable law, The Company is not liable for loss of profits or other incidental or consequential, lost revenue, lost business opportunities, loss of data, interruption of business, or any other direct, indirect, special, exemplary or punitive damages under any circumstances whatsoever, even if The Company had been advised of the possibility of such damages or if they were otherwise foreseeable.

Due to the inherent risks of using the Internet, The Company cannot be liable for any damage to, or viruses that may infect your computer equipment or any other property when you are using or browsing the Website. The downloading or other acquisition of any materials or information through the Website is done at your own discretion and risk and with your consent that you will be solely responsible for any damage to your computer system or loss of data that results from the downloading or acquisition of any such materials, except in case of direct fault committed by The Company.

Nothing in this section affects your rights as a consumer.

  • Windows® and the Windows Logo are registered trademarks of Microsoft.

Termination

The Company may remove the Website or cease the provision of The Product, at any time in its sole discretion for any reason whatsoever. Termination does not affect licences already granted.

Changes to the Terms and Conditions

The Company reserves the right to change the Terms and Conditions at any time and at its sole discretion. Changes do not apply retroactively to completed purchases and downloads.
